We know how real the risks of contaminated or dangerous products passed off as high-quality Kratom can be, and we are determined to do our part to prevent those problems. And for us, that means that we want to do what we can to support the Kratom Consumer Protection Act!
This act, which is being implemented on the state level as it is approved, has been worked on by the American Kratom Association and their advocates for many months. As states begin to approve the Kratom Consumer Protection Act, we’re happy to know that our customers will be guaranteed their safety and their rights.
What Is The Kratom Consumer Protection Act?
The Consumer Protection Act is a piece of legislation that would allow consumers to be able to keep buying Kratom legally while also helping to ban the sale of dangerous and adulterated products.
Nearly every risk of using Kratom today is because of unsafe and unregulated Kratom products. Because there are not as many regulation systems in place for this plant extract, its hard to know what is safe to take and what is not. For that reason, we think it’s great that the act is pushing the ban of unsafe Kratom products.
It’s important to note that while AKA is pushing forward suggested terms for the Kratom Consumer Protection Act, every state will be passing legislation individually, so some of the terms of the act may differ from state to state.
Still, the key points of the act will usually include clear information about the following:
- • Defines Kratom
- • Requires Kratom vendors, creators, and sellers to properly label products with specific labeling requirements
- • Prohibits sale of certain Kratom products altogether
- • Creates specific penalties for violations of these rules
- • Requires registration for Kratom production
- • Requires that the Department of Agriculture and Food set up standards and enforces them on Kratom production and sale
As you can see, all of these protocols will help to ensure that Kratom consumers are not put unnecessary risk whenever they buy their Kratom. Like other products, Kratom will be regulated and only permissible for sale if the vendors and producers care for it in safe and specific ways.
States That Have Passed The Act
As we mentioned, this act is being worked on in each state individually. This is happening because the federal government has given state’s the responsibility to regulate hemp production and sale, and we can safely assume that any rules about Kratom will happen on the state level as well.
So far, there are a few states which have passed some form of the Kratom act. The specific terms of each state’s rules may be different, but they are all derived from the same original act terms so you will see many similarities if you read the passed bills.
Utah
Utah passed their version of the act on March 26, 2019. Utah was the first state to pass a law about Kratom, and the entire country will hopefully soon follow in their footsteps!
Georgia
In Georgia, Kratom legislation was signed on April 27th. While Georgia did make some slight changes to the original proposed terms, the state was relatively quick and in favor of making this change to the laws. The laws will help ensure customer safety.
Arizona
KCPA passed in Arizona on May 1st, 2019. While we thought that Oregon might pass their new legislation first, Arizona won out by passing these rules just a short time ago!
Oregon
A similar Kratom Consumer Protection Act is very close to being passed as well. The State Senate Judiciary Committee unanimously approved the bill, so it will be taken to the floor to be officially voted on very soon. As we’re based in Oregon, we’ve been active in ensuring that our state legislature passes the KPCA, and we have every reason to believe they will!
Why We Support KCPA
For many vendors, additional regulations and rules to follow can seem like a death sentence. Most people don’t like being told what to do, and needing to follow more regulations in business can cause a loss of profits.
So why do we support the KCPA?
Simply put, we care about the safety of our customers!
We know that it is possible for Kratom companies to cut corners and break the rules when putting things on the market because there are not clear and official regulations about sales, labeling, or processing. This lack of regulation puts our customer’s at risk, and we want that to change.
Additionally, we believe that Kratom has been given a bad reputation because of the risks that some Kratom vendors subject all of their customers to. Kratom can be a very safe plant extract, but that can only be proven true if all vendors follow the appropriate manufacturing controls.
For Kratom to remain legal and safe for all Kratom lovers in future years, it’s important that states agriculture and food departments begin to regulate and manage all of the ways that Kratom is able to make its way to the market!
With the changes that the Kratom Consumer Protection Act can make in every state across the country, we even feel confident that our business would be better because our customers would feel safer and more confident in the quality of the products.
We already put sanitation, proper labeling, and good manufacturing practices first. We hope that soon every other Kratom vendor will have to do the same!

State legislation continues to be pushed forward by AKA, and we will continue to support these efforts as much as we possibly can! As we said, we find it to be very important to ensure that customers and the Kratom industry as a whole can be protected.
